…New York City had the largest gay population in the United States. It was also the city that most aggressively upheld anti-sodomy laws. In the mid-1960s New York created police vice squads to raid gay bars and baths, and began using decoys to solicit and entrap gays. By 1966 over 100 men a week were arrested as a result of this effort. "It was a nightmare for the lesbian or gay man who was arrested and caught up in the juggernaut but it was also a nightmare for the lesbians or gay men who lived in the closet," Yale Law School professor William Eskridge says in the film. "This produced an enormous amount of anger within the lesbian and gay community in New York City. Eventually something was bound to blow."

The Stonewall Inn was not a fancy establishment -- even its regular customers described it as a dive. Operated by the Mafia, the bar served watered-down drinks without a liquor license. Its two dark rooms had no running water -- just a tub where the drinking glasses were rinsed for reuse. The Stonewall Inn was, however, one of the only places gay people in New York City could socialize, providing a rare haven where they could drink, dance to the jukebox, and be themselves.  Photo

A Sense of Euphoria Settles on the West Village

People reacted outside the Stonewall Inn in New York City after the New York Senate passed a bill legalizing gay marriage. Photo

Supporters of the same-sex marriage bill danced in the streets of the West Village after the State Senate approved it on Friday night.

Crowds gathered, screamed and embraced in Sheridan Square near the Stonewall Inn, where the gay-rights movement began more than 40 years ago. Many stood on park benches to get a better view. Gay and lesbian bars in the neighborhood were packed with patrons, and the neighborhood had the feel of jubilant celebration.

“Equality is what this means; this is our right as people,” said John Huls, 52, standing in the Stonewall with his partner, Jay Hoff, 50. “It’ll be our same relationship. We’re the same people as when we met, except now it’s proper in the eyes of the state, and I’ll be able to look at people and say, ‘This is my husband.’ ” …

The Rev. Martin Kurylowicz got lots of hugs after Good Friday services at Sparta's Holy Family Catholic Church

"I was just filled with tears, there were so many hugs," said Kurylowicz, 47, following Friday's well-attended afternoon service. "It means more now, because they know the real me."

…He spoke up after attending a national conference on gay issues and the Catholic Church in early March. He was disturbed by accounts of homosexual children feeling isolated and parents feeling they did something wrong.

"I just couldn't walk away from it," he said. "I couldn't deny the pain."

He hopes his admission will raise awareness of violence against homosexuals and teen suicide, and help teach others that homosexuality is not a choice…

…A spokeswoman for the U.S. Catholic Bishops Conference said Kurylowicz's coming out to his congregation, first in a newsletter then from the pulpit on Holy Thursday, is "unprecedented." "No one knows of anyone who has spoken of this from the pulpit," said Sister Mary Ann Walsh. Photo 

"It was one part [being gay] of myself that was just closed off," says the youthful-looking 47-year old. But the feelings persisted.

"Just like any heterosexual, those feelings are always there," explains Kurylowicz, who speaks with a nervous but friendly intensity. "You're shamed by it every time they come up. Then you (start) running away.

"You stop being who you are. You become something that you think others will find more acceptable." Kurylowicz became a workaholic…

But he thought the source of his growing depression was overwork. He went into counseling, where in time he opened up about his sexuality.

"Every time I faced it, the better I felt," he recalls. He smiles often, furrows his brow frequently as he describes those days. Eventually he attended support groups for gays, which helped him shed layers of shame and fear. "It was the first time I saw more positive images of (gay) people," he says.
"I thought, 'What was I running away from?' "

…Meanwhile, classes in psychology and his own studies convinced Kurylowicz that homosexual orientation is not chosen,…

Gradually, he felt the pressure of suppressing his feelings lift, giving him "a tremendous capacity to live."

A few years ago he told family and friends he was gay. But he didn't decide to tell his congregation until he attended a national conference in March sponsored by New Ways Ministry, an organization advocating more understanding of gays in the Catholic Church.

Kurylowicz says his decision was triggered by a report that homosexually oriented children as young as 4 realize they're different. He was moved by the pain those children feel. Photo 

"Then I realized they don't have a voice, and I'm the one [a  Catholic priest] that's supposed to say something," Kurylowicz says. "That's why I couldn't walk away from it."…

Ricky Martin says he's 'a fortunate homosexual man'

LOS ANGELES, California (CNN) -- Pop singer Ricky Martin declared publicly this week what he avoided discussing for years: He is gay.

"I am proud to say that I am a fortunate homosexual man," Martin wrote on his official Web site. "I am very blessed to be who I am."

…Now, Martin wrote, "these years in silence and reflection made me stronger and reminded me that acceptance has to come from within and that this kind of truth gives me the power to conquer emotions I didn't even know existed."

His song "Livin' La Vida Loca" rose to the top of the music charts in 1999 and propelled Martin to stardom.

Martin said he decided years ago to not share "my entire truth" with the world because people he loved warned him that "everything you've built will collapse."

"Allowing myself to be seduced by fear and insecurity became a self-fulfilling prophecy of sabotage," he wrote. "Today I take full responsibility for my decisions and my actions." …

Catholics lead the way on same-sex marriage

The Washington Post-ABC News poll shows that same-sex marriage is supported by 53 percent of those surveyed. That's amazing. For the first time in the poll's history, the level of support for marriage equality cracked 50 percent. For the first time, a majority of  men (53 percent) say yes to allowing gays to wed. But what's truly historic is where white Catholics are on this issue.Photo

The question was straightforward: “Do you think it should be illegal or legal for gay and lesbian couples to get married?” In February 2010, an astounding 55 percent of white Catholics said "legal." In the current poll, the number jumped 8 points to 63 percent. This Post-ABC News poll corresponds with a Gallup poll I gasped at in June 2010. Majority of U.S. Catholics back gay rights in survey

In spite of, or perhaps because of, Roman Catholic church teachings condemning homosexuality, many lay Catholics in the United States be more accepting toward same-sex relationships than the general public, a new survey found.

“The big finding here is that American Catholics are at least 5 points more supportive than the general population across a range of gay and lesbian issues,” said Robert Jones, chief executive of the Public Religion Research Institute,…

Overall, the survey found 53 percent of Catholics supported the idea of same-sex marriage, while the general public is evenly divided on the issue. Fifty-six percent of Catholics did not believe sexual relations between two adults of the same gender constituted a sin, compared to 46 percent of the general population…

Marriage Equality will not become a reality until people learn that its most vital purpose is that it restores the “hope of love” to children in early childhood – essential to their development and well-being for life. 

Without Marriage Equality we teach children how to hate love and how to be mean and indifferent to people as adults. With all due respect, without Marriage Equality we would teach them in much the same way as has been shown by Benedict XVI and the hierarchy, especially in their lack of care and protection of children for decades.  

Sexual Orientation is less about sex and more about Love, being one with another human being.  Attachment Theory

The way to begin for us all, not only the NY State Senators, to protect Religious Freedom and not Tyranny in Religion is by obtaining a well-informed conscience.  We start by individually approaching and studying in (great detail because it involves the lives of children) from the best and the brightest (1) scripture scholars regarding the references related to homosexuality and (2) scientists in the field of study of human sexuality, in particular, but [not] limited to, the onset of sexual orientation.  The prerequisite to the formation of a well-informed conscience is making a thorough study of all sides of the issue from all available authoritative data and research, including opposing views. Then in this way we are better equipped to decide who and what needs government protection in regards to the gay marriage bill. This exhaustive procedure follows to the letter the Gospel quotation about the “plank” and the” speck.”
“How can you say to your brother, ‘Brother, let me take the speck out of your eye,’ when you yourself fail to see the plank in your own eye? You hypocrite, first take the plank out of your eye, and then you will see clearly to remove the speck from your brother’s eye”. Luke 6:42
The “plank” for us is ignorance.  If we satisfactorily resolve this ignorance, then together we will be able to see more clearly, whether or not, as NY State Senators (government officials) and as citizens we are colluding with the Catholic Hierarchy and are harming children, as was found to be the case in the Ireland Murphy Report.

Benedict XVI/Ratzinger – 30 years of power in the Vatican and in Secrecy

For the past 30 years, beginning in 1981, Benedict XVI has been able to establish a well-oiled machine of electing bishops, cardinals and procuring outside personnel to handle in secret “behind closed doors” (1) the silencing, removal of academics, theologians, priests, sisters and other religious personnel regarding issues related to the teaching of sexual orientation and (2) the ordering of the covering-up of child sexual abuse cases by use of intimidation in order to silence the victims and by  removing any priest, sister, or Catholic personal who breaks the silence of these cover-ups. In 2002, beginning in Boston this well maintained secrecy began to break up regarding decades of cover-ups of child sexual abuse with the global emergence of the internet. The use of the internet became an unstoppable vehicle of communications that help organize the sexual abuse victims to be able to go public – telling how they were intimidated, threatened and mistreated when they came to their local bishops for help… Photo

…The fact that the New York Republicans having been meeting now several days in secret regarding the gay marriage bill – it is a sign that Benedict XVI and the Hierarchy are already desperately trying to weave them into their decades of corruption.  This is the same way that so many government officials were involved in the child sexual abuse cover-ups and are now being held responsible and being convicted. Why all this secrecy surrounding the gay marriage bill?  What is so secret that cannot be discussed publicly?  There is something wrong here – KILL THE SECRECY – bring everything into the light – do not get caught up in their web of deceit.

“This is the verdict: Light has come into the world, but people loved darkness instead of light because their deeds were evil.” John 3:19

What New York Republican Senators do not want to protect is (1) the Vatican (Benedict XVI and the Hierarchy) from the legal repercussions related to the lifetime harm and violence that is caused to children by their unsubstantiated antigay teachings, because that would perpetuate the harm caused to children.  Secondly, (2) the New York Republican Senators do not want to protect the Vatican (Benedict XVI and the Hierarchy) from the legal repercussions and prosecution related to gay priests or any Catholic personnel who becomes a whistle-blower regarding the mistreatment and abuse of children, because that would maintain the secrecy and the cover-ups of child abuse in the Catholic Church.  If one thing that became vividly apparent from learning about the decades of Benedict XVI’s and the Hierarchy cover-ups is that there are “no checks and balances” in the Catholic Church and that is the Tyranny in Religion you do not want to protect...

The Importance of Acquiring a Well-Informed Conscience
On The Issue of Gay Marriage
This piece of legislation the gay marriage bill is not like any other in that it involves the well-being of children, at its very root. You have been given a “hot potato” because children do not have a voice to protect them, you are, and we are their voices. The responsibility that is involved in this gay marriage is tremendous and overwhelming. I know this because this is the same “hot potato” that landed in my lap, March 1997.   If you run from this responsibility, you will live with unending regret that you allowed innocent children to be continually harmed knowing that you had one chance in a lifetime to do something extraordinary for the well-being of children and people around the world. If you face and accept this responsibility of protecting children, you risk your political career, indeed your very life, as you know it. However, when I came out to my great surprise it was successful at my parish - Holy Family Catholic Parish, Sparta, Michigan and this was 1997.  I think that for the NY State Republican Senators today 2011 - the social climate as polls indicate is significantly better than it was in 1997 with the majority of Catholics now accepting gay marriage.  The reverse may be truer today for NY State Republican Senators that “not supporting gay marriage” could have an adverse effect on your political career.  Photo

I believe this to be true – because gay marriage (human sexuality, sexual orientation) is like Galileo it is about the true facts of science.  Condemning Galileo showed real ignorance on the part of the Vatican, which Pope John Paul II confirmed and apologized for in 1992. Even though, it is indeed a most unfair situation to be placed in. How I resolved this situation was through hours upon hours of continuous prayer. Afterwards, I came to the realization that my life had already been altered – changed forever. Because there was no way I could pretend I did not know what I knew, how severely children are harmed for life by the [Vatican's/Benedict XVI's] unsubstantiated antigay teachings and antigay social norms. I decided that I could not live with the regret knowing that I had a chance to make a profound difference for the better for others, most especially children and that I did nothing. My life would be nothing. I took the bungee jump and I came out to my parishioners. It definitely was not easy, but one thing that happened to me is - I gained a real sense of peace and well-being that has remained constant and unshaken.  The scripture passages that kept repeating over and over in my head were:

“For whoever wants to save their life will lose it, but whoever loses their life for me will find it.” Matthew 16:25

“What good is it for someone to gain the whole world, and yet lose or forfeit their very self?” Luke 9:25 

“Anyone who loves their FATHER or mother more than me is not worthy of me;… Whoever does not take up their cross and follow me is not worthy of me.” Matthew 10:36-38

 “…whoever causes one of these little ones who believe in Me to stumble, it would be better for him to have a heavy millstone hung around his neck, and to be drowned in the depth of the sea.” Matthew 18:6

Even after Benedict XVI and his accomplices’ mistreatment of me and the serious harm they have caused me that sense of peace has never left me. It is remains rock solid. I believe that is the benefit of spending the time and energy of acquiring a well-informed conscience regarding sexual orientation...

My name is Fr. Marty Kurylowicz, a Roman Catholic priest from the Diocese of Grand Rapids Michigan ordained June 16, 1979.

In March 1997, after attending a National Symposium of the New Ways Ministry that was held in Pittsburgh, Pennsylvania, I learned that children as young as 4 and 5 years of age know that they are different. This feeling "different" is only identified in their adult years as being gay. However, the harmful influence of antigay social and religious norms -- in particular, for Catholics, the Vatican’s unsubstantiated antigay teachings -- are severe and last throughout a child’s lifetime. The harmful effects are not isolated only to these children who grow up to be gay, but also affect their families, siblings, friends and anyone whom they might consider special in their lives. They are a prescribed societal sentence of implicit isolation, which place at risk of suicide so many innocent adolescents and young adults. They stifle an enormous amount of human potential in the world that otherwise could be put to use for finding cures for diseases, offering better ways of maintaining peace among people and improving the quality of life for everyone in the world…

The Vatican will submit a long-overdue report on its treatment of children to the United Nations this fall, the Holy See's envoy in Geneva said Monday.

Amnesty names Vatican over human rights abuses – May 13, 2011

Who are unwilling to guarantee any type of lifetime  immunity from any future prosecution from the legal repercussions related to the lifetime harm and violence that is caused to children [another even more severe  form of child abuse] caused by the Vatican’s (Benedict XVI and the Hierarchy) unsubstantiated antigay teachings.

GAY MARRIAGE, bishops and the crisis of leadership – “CATHOLIC HIERARCHY has lost most of its credibility..." July 5, 2011

The vote approving same-sex marriage in New York is the latest and most glaring confirmation of some gloomy news for the Catholic church in the United States, and it’s not that gays have achieved the right to marry. Photo
Rather, affirmed in the recent vote is the disturbing reality that the Catholic hierarchy has lost most of its credibility with the wider culture on matters of sexuality and personal morality, just as it has lost its authority within the Catholic community on the same issues. There are reasons -- and they have little to do with secularism, relativism or lingering influences of the wild 1960s -- why people are no longer listening to the bishops.
While we don’t want to minimize the seriousness of the concern of some over a societal redefinition of marriage, there are reasons we think the bishops’ hyperbolic reaction to laws such as that enacted in New York are not only wrong-headed but counterproductive.
First, even if bishops retained the stature they once had in the wider culture, it is evident in polls and politicians’ votes that neither most of the Catholic world nor the wider culture buys the church’s teaching that homosexuals are disordered and are thus relegated to sexless lives in order to remain in the Christian community…

However, when I came out to my great surprise it was successful at my parish - Holy Family Catholic Parish, Sparta, Michigan and this was 1997.  I think that for the NY State Republican Senators today 2011 - the social climate as polls indicate is significantly better than it was in 1997 with the majority of Catholics now accepting gay marriage.  The reverse may be truer today for NY State Republican Senators that “not supporting gay marriage” could have an adverse effect on your political career. I believe this to be true – because gay marriage (human sexuality, sexual orientation) is like Galileo - it is about the true facts of science.  Condemning Galileo showed real ignorance on the part of the Vatican, which Pope John Paul II confirmed and apologized for in 1992

In the 1633 trial of Galileo Galilei, two worlds come into cosmic conflict.  Galileo's world  of science and humanism collides with the world of Scholasticism and absolutism that held power in the Catholic Church.  The result is a tragedy that marks both the end of Galileo's liberty and the end of the Italian Renaissance. Galileo Galilei was born in 1564--the same year that Shakespeare was born and Michelangelo died.  From an early age, Galileo showed his scientific skills... Eventually, he would be recognized as the father of experimental physics.  Galileo's motto might have been "follow knowledge wherever it leads us."
…When depositions in the Galileo matter concluded, the Commissary-General forwarded two propositions of Galileo to eleven theologians (called "Qualifiers") for their evaluation: (1) The Sun is the center of the world and immovable of local motion, and (2) The Earth is not the center of the world, nor immovable, but moves according to the whole of itself, also with a diurnal motion.  Four days later, on February 23, 1616, the Qualifiers unanimously declared both propositions to be "foolish and absurd" and "formally heretical."  Less than two weeks later, Pope Paul V--described by the Florentine ambassador as "so averse to anything intellectual that everyone has to play dense and ignorant to gain his favor"--endorsed the theologian's conclusions…

Galileo's admonition stopped the Copernican movement dead in its tracks.  For Galileo, his admonition marked the beginning of a period of silence…and adjusted to a world which elevated mindless conformism over scientific understanding.

With a formal statement at the Pontifical Academy of Sciences on Saturday, Vatican officials said the Pope will formally close a 13-year investigation into the Church's condemnation of Galileo in 1633. The condemnation, which forced the astronomer and physicist to recant his discoveries, led to Galileo's house arrest for eight years before his death in 1642 at the age of 77.
The dispute between the Church and Galileo has long stood as one of history's great emblems of conflict between reason and dogma, science and faith. The Vatican's formal acknowledgement of an error, moreover, is a rarity in an institution built over centuries on the belief that the Church is the final arbiter in matters of faith…



Child abuse tragedy made worse by Irish bishops and Vatican – July 14, 2011

The Cloyne report has found that the Vatican’s reaction to the (Irish bishops’) 1996 framework document was “entirely unhelpful” to any Irish bishop who wanted to implement it and gave individual Irish bishops freedom to ignore it.
The Vatican refused to give the document “recognitio”; told the Irish bishops it was “not an official document of the Episcopal Conference but a study document”; and warned that it could be in breach of canon law. It also said the document’s advice on mandatory reporting gave rise to “serious reservations of both a moral and a canonical nature”.
The Vatican did so in a confidential letter circulated by the then papal nuncio to Ireland Archbishop Luciano Storero to every Irish bishop in January 1997, a year after the Irish bishops’ guidelines came into play.
Nor has the Vatican ratified or given the “recognitio” to the Irish Catholic Church’s 2005 updated guidelines. The papal nuncio Archbishop Giuseppe Leanza refused to explain any of this to the Cloyne commission, as was the case beforehand with the Murphy commission.
Msgr Denis O’Callaghan, vicar general and delegate in Cloyne diocese, “stymied” implementation of the 1996 document in Cloyne. He was allowed do so by Bishop John Magee who “took little or no active interest in the management of clerical child sexual abuse cases until 2008 . . .”

...Given the clear teaching of the Catholic Church, I am puzzled, shocked and horrified that the scandal, sin and crime of sexual abuse of children by clerics of the Catholic Church continues to harm the church, and that Pope Benedict XVI seems unable to grasp the damage. Perhaps Enda Kenny, the Taoiseach or prime minister of Ireland, still one of the most faithful Catholic countries in the world, may help bring the pope to his senses.
Kenny used his high office and the Dail (parliament) to deliver a withering damnation of the church authorities, declaring "the dysfunction, disconnection, elitism, the narcissism that dominate the culture of the Vatican to this day…
The 400-page Cloyne report claimed that the attitude of the Vatican had been "entirely unhelpful" in describing guidelines on how to deal with abuse claims as "merely a study document."
…Kenny claimed that the report exposed, "an attempt by the Holy See to frustrate an inquiry in a sovereign, democratic republic as little as three years ago, not three decades ago ... The rape and torture of children were downplayed or 'managed' to uphold instead the primacy of the institution, its power, standing and reputation.
"Far from listening to the evidence of humiliation and betrayal with St Benedict's 'ear of the heart,' the Vatican's reaction was to parse it and analyze it with the gimlet eye of a canon lawyer. This calculated, withering position being the polar opposite of the radicalism, humility and compassion upon which the Roman Church was founded."…

After a dramatic week, the New York State Senate voted 33-29 to allow gays and lesbians to marry. The Assembly quickly passed the Senate’s version of the marriage equality bill and Gov. Andrew Cuomo immediately signed it…
…The Buffalo Republican (once a Democrat) ran for office promising to oppose same-sex marriage. After agonizing for months, [Mark] Grisanti concluded he was wrong.
“I cannot deny a person, a human being, a taxpayer, a worker, the people of my district and across this state, the state of New York, and those people who make this the great state that it is the same rights that I have with my wife,” Grisanti said.
And then he voted yes…
Another tip of the hat goes to Senate Majority Leader Dean Skelos, R-Long Island, who allowed his chamber to vote its conscience. “The days of just bottling up things, and using these as excuses not to have votes — as far as I’m concerned as leader, its over with,” he told The New York Times. Perhaps next he can put an end to the secrecy and backroom dealing that preceded the vote.
In the end, the vote to approve same-sex marriage was about conscience — how, in good conscience, the state could no longer deny gay couples the 2,462 rights and responsibilities conferred by civil marriage…

VATICAN CITY (Reuters) - The Vatican accused Italian media on Tuesday of waging an "insulting" smear campaign against it and Pope Benedict by running embarrassing stories about palace intrigue and Byzantine plotting inside its walls.

With a rare statement issued by its Secretariat of State, the Vatican broke its silence after two weeks of stories about events that led up to the resignation last September of Dino Boffo, influential editor of the Catholic newspaper Avvenire.

The reports said top Vatican officials had sent an Italian newspaper owned by Prime Minister Silvio Berlusconi's family a false document alleging Boffo had been accused of harassment by a woman with whose husband he was having a homosexual affair.

Since January 23, Vatican officials have seen stories with headlines such as "The Poison of Cardinals," "Vatican Intrigue" and "Hunger for Power in the Vatican."…

VATICAN CITY — The Vatican denied Tuesday that it leaked documents that led to the resignation of a prominent Catholic editor, intervening in a tale of ecclesiastical intrigue that has dominated Italian headlines for weeks.

The Vatican No. 2 issued a statement saying reports that Vatican officials leaked the documents were false and that Pope Benedict XVI himself "deplored these unjust and insulting attacks" that were "defaming the Holy See."

The statement — unusual in its line-by-line denial of unsourced rumors — was confirmation that what had been a strictly Italian church scandal had reached the highest echelons of power in the Vatican's Apostolic Palace and that the pope clearly wanted to put an end to it…

In March 1997, after attending a National Symposium of the New Ways Ministry that was held in Pittsburgh, Pennsylvania, I learned that children as young as 4 and 5 years of age know that they are different. This feeling "different" is only identified in their adult years as being gay. However, the harmful influence of antigay social and religious norms -- in particular, for Catholics, the Vatican’s unsubstantiated antigay teachings -- are severe and last throughout a child’s lifetime.  

The harmful effects are not isolated only to these children who grow up to be gay, but also affect their families, siblings, friends and anyone whom they might consider special in their lives. They are a prescribed societal sentence of implicit isolation, which place at risk of suicide so many innocent adolescents and young adults. Standard of Review

The Supreme Court has yet to rule on the appropriate level of scrutiny for classifications based on sexual orientation.   It has, however, rendered a number of decisions that set forth the criteria that should inform this and any other judgment as to whether heightened scrutiny applies:   (1) whether the group in question has suffered a history of discrimination; (2) whether individuals “exhibit obvious, immutable, or distinguishing characteristics that define them as a discrete group”; (3) whether the group is a minority or is politically powerless; and (4) whether the characteristics distinguishing the group have little relation to legitimate policy objectives or to an individual’s “ability to perform or contribute to society.”   See Bowen v. Gilliard, 483 U.S. 587, 602-03 (1987); City of Cleburne v. Cleburne Living Ctr., 473 U.S. 432, 441-42 (1985).  

Each of these factors counsels in favor of being suspicious of classifications based on sexual orientation.   First and most importantly, there is, regrettably, a significant history of purposeful discrimination against gay and lesbian people, by governmental as well as private entities, based on prejudice and stereotypes that continue to have ramifications today.   Indeed, until very recently, states have “demean[ed] the[] existence” of gays and lesbians “by making their private sexual conduct a crime.”   Lawrence v. Texas, 539 U.S. 558, 578 (2003).iii

Second, while sexual orientation carries no visible badge, a growing scientific consensus accepts that sexual orientation is a characteristic that is immutable, see Richard A. Posner, Sex and Reason 101 (1992); it is undoubtedly unfair to require sexual orientation to be hidden from view to avoid discrimination,see Don’t Ask, Don’t Tell Repeal Act of 2010, Pub. L. No. 111-321, 124 Stat. 3515 (2010).

Third, the adoption of laws like those at issue in Romer v. Evans, 517 U.S. 620 (1996), and Lawrence, the longstanding ban on gays and lesbians in the military, and the absence of federal protection for employment discrimination on the basis of sexual orientation show the group to have limited political power and “ability to attract the [favorable] attention of the lawmakers.”   Cleburne, 473 U.S. at 445.   And while the enactment of the Matthew Shepard Act and pending repeal of Don’t Ask, Don’t Tell indicate that the political process is not closedentirely to gay and lesbian people, that is not the standard by which the Court has judged “political powerlessness.”   Indeed, when the Court ruled that gender-based classifications were subject to heightened scrutiny, women already had won major political victories such as the Nineteenth Amendment (right to vote) and protection under Title VII (employment discrimination).  

Finally, there is a growing acknowledgment that sexual orientation “bears no relation to ability to perform or contribute to society.”   Frontiero v. Richardson, 411 U.S. 677, 686 (1973) (plurality).   Recent evolutions in legislation (including the pending repeal of Don’t Ask, Don’t Tell), in community practices and attitudes, in case law (including the Supreme Court’s holdings in Lawrence andRomer), and in social science regarding sexual orientation all make clear that sexual orientation is not a characteristic that generally bears on legitimate policy objectives.   See, e.g., Statement by the President on the Don’t Ask, Don’t Tell Repeal Act of 2010 (“It is time to recognize that sacrifice, valor and integrity are no more defined by sexual orientation than they are by race or gender, religion or creed.”)

To be sure, there is substantial circuit court authority applying rational basis review to sexual-orientation classifications.   We have carefully examined each of those decisions.  Many of them reason only that if consensual same-sex sodomy may be criminalized under Bowers v. Hardwick, then it follows that no heightened review is appropriate – a line of reasoning that does not survive the overruling of Bowers inLawrence v. Texas, 538 U.S. 558 (2003).iv Others rely on claims regarding “procreational responsibility” that the Department has disavowed already in litigation as unreasonable, or claims regarding the immutability of sexual orientation that we do not believe can be reconciled with more recent social science understandings.v And none engages in an examination of all the factors that the Supreme Court has identified as relevant to a decision about the appropriate level of scrutiny.   Finally, many of the more recent decisions have relied on the fact that the Supreme Court has not recognized that gays and lesbians constitute a suspect class or the fact that the Court has applied rational basis review in its most recent decisions addressing classifications based on sexual orientation, Lawrenceand Romer.vi But neither of those decisions reached, let alone resolved, the level of scrutiny issue because in both the Court concluded that the laws could not even survive the more deferential rational basis standard…

GENEVA (Reuters) - People who criticise gay sexual relations for religious or moral reasons are increasingly being attacked and vilified for their views, a Vatican diplomat told the United Nations Human Rights Council on Tuesday.

Archbishop Silvano Tomasi said the Roman Catholic Church deeply believed that human sexuality was a gift reserved for married heterosexual couples. But those who express these views are faced with "a disturbing trend," he said.

"People are being attacked for taking positions that do not support sexual behaviour between people of the same sex," he told the current session of the Human Rights Council.
